1. Acceptance of Terms

By creating an account or using the Planning Poker® service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization.

2. Description of Service

Planning Poker® is a web-based agile estimation tool that enables teams to collaborate in real-time for project planning and estimation. The Service includes features such as:

• Creating and managing estimation sessions
• Real-time voting and collaboration
• Integration with third-party tools (e.g., Linear)
• Team workspace management
• Session history and analytics

3. Age Requirements

You must be at least 13 years of age to use the Service. If you are under 18, you must have your parent or legal guardian's permission to use the Service. By using the Service, you represent that you meet these age requirements.

4. Acceptable Use Policy

You may use the Service for any lawful purpose, including commercial use within your organization. You agree not to:

• Resell, redistribute, or sublicense the Service
• Use the Service to violate any laws or regulations
• Attempt to gain unauthorized access to the Service or its systems
• Use automated means to access the Service without our permission
• Interfere with or disrupt the Service or its infrastructure
• Upload malicious content or use the Service to distribute malware
• Exceed API rate limits or create excessive load on our systems
• Scrape, mine, or harvest data from the Service
• Impersonate others or provide false information
• Use the Service for illegal, harmful, or offensive purposes

5. User Accounts and Team Workspaces

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Team workspace owners are responsible for managing member access and permissions. You retain all ownership rights to the data you submit to the Service. We will not share your data with third parties except as described in our Privacy Policy or as required by law.

7. Data Processing and Storage

Your data is processed and stored using the following infrastructure:

• Database and Authentication: Supabase (PostgreSQL) hosted in US regions
• Application Hosting: Vercel with global CDN distribution
• Real-time Features: WebSocket connections for live collaboration

Session data, including votes and comments, is retained for active accounts. Deleted sessions are permanently removed within 30 days. We implement industry-standard security measures to protect your data.

8. Payment Processing

Payment processing is handled by Stripe, a PCI-compliant payment processor. By using paid features, you agree to Stripe's terms of service. We do not store credit card information on our servers.

Billing: Subscriptions are billed monthly or annually in advance. Fees are non-refundable except as required by law.

Refund Policy: Annual plans may receive pro-rated refunds within 30 days of purchase. Monthly plans are non-refundable. Contact support for refund requests.

Disputes: Payment disputes should first be directed to our support team. Unresolved disputes may be handled through Stripe's dispute resolution process.

Price Changes: We reserve the right to change pricing with 30 days notice to existing customers.

9. Third-Party Services and Integrations

The Service integrates with third-party services including:

• Linear: For importing issues and syncing estimates. Use of Linear integration requires authorization and is subject to Linear's terms of service.
• OAuth Providers: Google and GitHub for authentication

API rate limits apply to prevent abuse. Excessive API usage may result in temporary suspension of integration features.

10. Real-time Collaboration Features

The Service provides real-time collaboration through WebSocket connections. Features include:

• Live voting and presence indicators
• Instant updates across all connected clients
• Session recording for history and analytics

Real-time features require a stable internet connection. We are not responsible for issues caused by network connectivity problems.

11. Free and Paid Tiers

Free Tier: Includes basic features with limitations on session history, team size, and integrations.

Paid Tiers: Unlock additional features including unlimited history, larger teams, priority support, and advanced integrations.

Features may vary by plan. Current plan details are available on our pricing page.

12. Data Retention and Deletion

We retain your data as follows:

• Active Sessions: Retained while your account is active
• Deleted Sessions: Permanently removed within 30 days
• Account Data: Retained for 90 days after account closure
• Anonymized Analytics: May be retained indefinitely

You can request data deletion by contacting support. Some data may be retained as required by law or for legitimate business purposes.

13. Data Export and Portability

You can export your data at any time through the Service's export features. Exports include:

• Session history and voting data
• Team member lists
• Estimation results

Data is exported in standard formats (CSV, JSON) for easy portability.

14. Privacy and Cookies

We use cookies and similar technologies to provide and improve the Service. This includes:

• Authentication cookies to keep you logged in
• Preference cookies to remember your settings
• Analytics cookies to understand usage patterns

15. Service Interruptions and Maintenance

While we aim for 99.9% uptime, the Service may be temporarily unavailable due to:

• Scheduled maintenance (with advance notice when possible)
• Emergency maintenance or security updates
• Third-party service outages (Vercel, Supabase, Stripe)
• Force majeure events

We are not liable for any loss or damage resulting from Service interruptions.

16. GDPR and Privacy Compliance

For users in the European Union, we comply with GDPR requirements including:

• Right to access your personal data
• Right to rectification and erasure
• Right to data portability
• Right to object to processing

17. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

18. Termination

We may terminate or suspend your account for violations of these Terms. You may cancel your account at any time through account settings.

Upon termination:

• Your access to the Service will cease immediately
• Active subscriptions will be cancelled
• Data will be retained per our retention policy
• You may request data export before deletion

19. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
